Terms of Service and End-User Licence

These terms are a legal agreement between you and Mishra Agritech Pty Ltd (ACN 697 029 119, ABN 90 697 029 119) of 11 Hassall St, Parramatta NSW 2150, Australia (“Mishtro”, “we”, “us”). They cover the Mishtro mobile app for iOS and Android, the Mishtro website and the services behind them (together, the “Service”). The app asks you to accept these terms and our Privacy Policy on its first screen; by accepting there, or by installing or using the Service, you agree to them. If you do not agree, do not use the Service.

Nothing in these terms removes rights you have under laws that cannot be excluded by agreement, including the Australian Consumer Law, the Consumer Protection Act 2019 (India), and consumer and data-protection laws in the United Kingdom, the European Union and elsewhere. Where a term here conflicts with such a right, the right prevails.

1. Who may use Mishtro

  • You must be at least 18 years old to create an account, subscribe or chat with Guruji.
  • You may enter birth details for other people, including your children and family members, only if you are responsible for them or have their permission. If you provide personal information about another person, you represent that you have their informed permission or another lawful authority to do so, and that you have told them about our Privacy Policy where it is appropriate to do so. The app asks you to confirm this each time you add someone other than yourself. You are responsible for the accuracy of what you enter and for honouring their wishes about that data, including a request to delete it.
  • You may use the Service only where it is lawful to do so.

2. What the Service is, and what it is not

Mishtro computes Vedic (Jyotisha) birth charts using classical Parashari rules, and narrates readings, daily notes, compatibility assessments and a conversation with “Guruji”. The chart mathematics is deterministic. The narration, the daily commentary and every Guruji reply are generated by artificial-intelligence language models running on our servers.

Readings are interpretive and for personal reflection, cultural interest and spiritual guidance only. They are not predictions of fact, and they are not medical, psychological, legal, financial, investment, marital, fertility or safety advice. Do not make health, money, legal, relationship or life-safety decisions on the basis of anything the Service says. If you are in distress or thinking about harming yourself, contact local emergency services or a crisis line (in Australia, Lifeline 13 11 14; in India, Tele-MANAS 14416 or KIRAN 1800-599-0019).

AI-generated text can be wrong, incomplete or inconsistent, and a chart is only as accurate as the birth time and place you enter. A birth time that is uncertain by even a few minutes can change the ascendant and house positions. We have no independent way to verify your inputs.

3. Your account

You sign in with your email address and a one-time code. No password is stored. Keep your email account secure: anyone who can read your email can sign in as you. An account is for one person; do not share it. Tell us at support@mishraagritech.com if you believe your account has been used without your permission.

You can use most of the Service without an account. Charts computed while signed out are returned to your device and are not kept on our servers. Saving profiles, charts, conversations, reflections and streaks requires an account.

4. Mishtro Pro, the free trial and payments

4.1 What is free

Without a subscription you can chart up to three people (counted per account, or per phone while you are signed out; charting one of those three again is always free), read two compatibility pairs, and see the partial daily reading (the day’s score, headline and sky facts). To keep the free limits to one set per phone we record a device identifier (on Android the Android ID, on iOS the identifier for vendor, otherwise an install identifier we generate), the device model, the app version and the internet address the request came from. Using the free features on a device is your consent to this measure.

4.2 Mishtro Pro

  • Conversations with Guruji (typed and voice, including the couple chat), the full daily reading, charts for more than three people and more than two compatibility pairs require Mishtro Pro, a subscription in one of three plans: monthly (store product mishtro_chat_monthly), three months (mishtro_chat_three_month) or six months (mishtro_chat_half_yearly). All three unlock the same thing; they differ only in how often you are billed.
  • The free trial. The monthly plan starts with seven days free where the store offers it. You subscribe first, nothing is charged during the trial, and the first monthly payment is taken by your store when the trial ends unless you cancel at least 24 hours before then. The trial is granted by Apple or Google to a store account once; a second subscription on the same store account starts at the full price. The three-month and six-month plans have no trial.
  • The price is shown in your local currency in the App Store or Google Play purchase sheet before you confirm. Prices may differ by country and may change; any change applies from your next renewal and you will be told in advance.
  • The subscription renews automatically at the end of each period (every month, every three months or every year, by the plan you chose) and your store account is charged at the start of each period, unless you cancel at least 24 hours before the current period ends.
  • Payment is taken by Apple or Google, not by us. We never see your card details. Manage or cancel the subscription in your App Store subscription settings or in Google Play under Payments and subscriptions. Deleting the app does not cancel the subscription.
  • Cancelling stops future renewals; you keep access until the end of the period you have paid for. Refunds for periods already charged are handled under the refund policies of Apple and Google, and under any consumer law that applies to you. In Australia you are entitled to a remedy if the Service fails to meet a consumer guarantee. In India your rights under the Consumer Protection Act 2019 are not affected.
  • Use Restore purchase in the app if you reinstall or change phones. The subscription is tied to your Mishtro account and to the store account that paid for it.
  • Subscription state is confirmed for us by RevenueCat, our subscription-management provider, and by the stores. If the store reports a purchase as refunded, reversed or in a billing problem, access may be paused until it is resolved.

Apple and Google are not parties to these terms and have no obligation to you under them, other than their own store terms.

5. Acceptable use

You agree not to:

  • use the Service to harass, threaten, defame or harm anyone, or to make decisions that discriminate against a person because of what a chart says;
  • enter another person’s details without a right to do so, or use the Service to stalk or profile someone;
  • attempt to obtain outputs that are illegal in your jurisdiction, or to circumvent the safety limits built into Guruji;
  • scrape, crawl or bulk-download readings, or access the Service with scripts, bots or automated tools;
  • circumvent the free limits or the free trial (for example by falsifying device identifiers), share subscription access, or resell the Service;
  • reverse engineer, decompile or extract the app, our astrological engine, our knowledge base or our prompts, except where a law expressly permits it;
  • interfere with the security or availability of the Service, or probe our servers for vulnerabilities without written permission.

6. Your content

Birth details, names, conversations, reflections, notes and anything else you enter (“Your Content”) remain yours. You give us a non-exclusive, worldwide licence to store, process and display Your Content only as needed to run the Service for you, to generate your readings, to keep your account secure and to meet our legal obligations. The licence ends when you delete the content or your account, subject to backups being cleared within the period stated in the Privacy Policy.

We do not use Your Content to train AI models, and we contractually require the AI providers we use not to do so either.

You are responsible for Your Content. Do not enter information you are not allowed to share, or that you would not want summarised into a reading.

7. Our intellectual property

As between you and us, we retain all rights in the Service, including its software, astrological engine, scoring methods, prompts, templates, knowledge base, design, brand and other underlying materials. They are protected by copyright, trade-mark and other laws. We grant you a limited, personal, non-transferable, revocable licence to use the app on devices you own or control.

Subject to these terms, you may save, use and share the readings generated for you for personal, non-commercial purposes, including sharing a screenshot with a friend. You may not sell, license, scrape, bulk extract, reproduce at scale, use to train an AI model, or incorporate the Service or its outputs into a product or service, without our written permission.

Vedic astrology itself is a tradition in the public domain; nothing here claims ownership of it.

8. Third-party services

The Service depends on providers listed in the Privacy Policy, including Supabase (database and sign-in), Vercel (hosting), RevenueCat (subscriptions), Apple and Google (distribution and payment), AI inference providers, OpenStreetMap Nominatim and Photon (place lookup) and Expo (app updates). Their availability is outside our control, and their own terms apply to your use of their platforms.

9. Additional terms for iOS users

These terms are between you and us, not Apple. Apple is not responsible for the app or its content. The licence in section 7 is limited to Apple-branded devices you own or control, as permitted by the App Store Terms of Service, except that the app may be accessed by other accounts associated with you through Family Sharing or volume purchasing. We, not Apple, are solely responsible for maintenance and support, for any product warranties (to the extent not disclaimed), for addressing claims relating to the app (including product-liability, legal or regulatory compliance and consumer protection claims), and for investigating and resolving any third-party claim that the app infringes intellectual-property rights. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the app; Apple has no other warranty obligation. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Warranties and liability

Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Subject to those guarantees and to any other right that cannot be excluded, the Service is provided “as is” and “as available”. We do not warrant that readings are accurate, that Guruji’s replies are correct, that the Service will be uninterrupted or error-free.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of data or loss of opportunity, and our total liability to you for all claims arising from the Service in any twelve-month period is limited to the greater of AUD 50 and the amount you paid us for the Service in that period. Where liability cannot be limited in this way, it is limited to re-supplying the service or paying the cost of having it re-supplied. Nothing in this section limits liability for death, personal injury, fraud or anything that cannot lawfully be limited.

11. Suspension and termination

You can stop using the Service at any time and delete your account from inside the app (account badge, top right, then “Delete account”), or from our account deletion request page if you cannot get into the app. Deletion is permanent and removes everything tied to the account, apart from the limited billing records the Privacy Policy explains we must keep for tax and accounting. It does not cancel a store subscription; cancel that with Apple or Google.

We may suspend or close your account if you breach these terms, if we are required to by law, or if continuing would create a risk to other users or to the Service. We will tell you why, unless the law prevents it. If we close your account for a reason other than your breach while you hold an active subscription, we will help you seek a pro-rata refund from the store.

We may change or discontinue features, including the free limits, the free trial or the subscription, with reasonable notice where the change affects something you have paid for.

12. Changes to these terms

We may update these terms. The effective date and version number at the top identify the text you are reading, and we keep the superseded versions. For material changes the app asks you to accept the new version before it applies to you, and records which version you accepted and when. If you do not accept them, stop using the Service and delete your account.

13. Governing law and disputes

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia. If you live outside Australia, you keep the protection of any mandatory consumer or data-protection law of the country where you live, and you may bring a claim in your local courts where that law allows.

Users in India may also raise a complaint with our Grievance Officer (see the Privacy Policy) and with the consumer commission of their district, state or the National Consumer Disputes Redressal Commission. If you live in the European Union or the United Kingdom, you may also have the right to contact your local consumer-protection body, alternative dispute-resolution body, or data-protection authority, where applicable. We will always try to resolve a dispute directly first: email us and we will respond within 15 days.

14. General

  • If any part of these terms is unenforceable, the rest continues to apply.
  • These terms and the Privacy Policy are the whole agreement between you and us about the Service.
  • We may assign these terms to a successor of the business; you may not assign them.
  • Our failure to enforce a term is not a waiver of it.
  • Neither party is liable for delay caused by events outside its reasonable control.
  • You must comply with any export-control or sanctions law that applies to your use of the app.
